By accessing or using Sirv AI Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Sirv AI Studio provides AI-powered image and video processing services, including but not limited to:

  • Background removal and replacement
  • Image upscaling and enhancement
  • AI image and video generation
  • Product lifestyle image creation
  • Virtual try-on
  • Workflow automation (Orchestrator)

3. Account Registration

  • You may need to create an account to access certain features
  • You are responsible for maintaining the security of your account
  • You must provide accurate and complete information
  • You are responsible for all activities under your account
  • You must be at least 13 years old to use the Service

4. Credits and Payments

  • Some features require credits to use
  • Credits can be purchased through our payment system
  • Credits are non-refundable except as required by law
  • Free credits may be provided and may expire
  • We reserve the right to modify pricing at any time
  • Unused credits do not expire unless otherwise stated

5. Acceptable Use

You agree NOT to use the Service to:

  • Upload or process illegal content
  • Create deepfakes or misleading content intended to deceive
  • Generate content that infringes on intellectual property rights
  • Create content depicting minors inappropriately
  • Generate hateful, harassing, or violent content
  • Attempt to bypass usage limits or security measures
  • Use the Service for spam or unauthorized commercial purposes
  • Reverse engineer or attempt to extract AI models

6. Content Ownership

  • You retain ownership of images you upload
  • You grant us a license to process your images as needed to provide the Service
  • You are responsible for having the right to use any images you upload
  • AI-generated content may be subject to the terms of underlying AI models
  • We do not claim ownership of your processed images

7. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service
  • We may modify, suspend, or discontinue features at any time
  • Scheduled maintenance will be communicated when possible
  • We are not liable for any downtime or service interruptions

8. Third-Party Services

The Service integrates with third-party providers including fal.ai for AI processing and Sirv for CDN services. Your use of these integrations is subject to their respective terms of service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED. AI-GENERATED RESULTS MAY VARY AND ARE NOT GUARANTEED TO MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless Sirv AI Studio and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

  • You may terminate your account at any time
  • We may suspend or terminate your account for violation of these Terms
  • Upon termination, your right to use the Service ceases immediately
  • Provisions that should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
